This Privacy Notice is provided by RADAR, Inc. to inform you of our commitment to you, our website visitors, our customers who purchase our services, and individuals whose personal information is stored in any of our systems or software. All capitalized definitions are meant in the manner described in the Terms of Use located here: www.radarfirst.com/termsofuse.

RADAR, Inc. has certified this Website (www.radarfirst.com) and its Product (as defined in the Terms of Use, and accessible at app.radarfirst.com) under both the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield frameworks set forth by the U.S. Department of Commerce and the European Union. You may verify RADAR’s participation in the EU-U.S. Privacy Shield list and the Swiss-U.S. Privacy Shield list here.

RADAR, Inc., protects your privacy through the application of the Privacy Shield principles to your privacy rights and our internal privacy policies. This document demonstrates how we apply those principles to protect your privacy.

Any new versions of this Privacy Notice will take effect the earlier of (1) exactly one month after the “Updated:” date indicated at the top of this page, or (2) the date of execution or amendment of any customer Agreement and the then-visible version of this Privacy Notice on the Website.

All references to the Agreement only apply to Customers (paid subscribers).

The Privacy Notice is organized below with reference to the applicable Privacy Shield principles, which are also supportive of other privacy protection frameworks.

We provide to you with this Privacy Notice so that you can make informed choices regarding your personal information.

What Data We Collect

We do not collect personal information from website visitors such as name, address, e-mail address, or phone number, unless it is voluntarily provided in form and submitted to us. If you interact with the Website and provide your contact information in a form, you are clearly consenting to allow us to use that information to contact you for purposes related to that form.

Notices Regarding Cookies and Browser Information

We collect certain publicly available non-personal information that your browser transmits as part of its normal interaction with the internet. Such information may include your device, its operating system, your browser brand and version, your installed web fonts, your browser’s language settings, the IP address of your origin, and other technical information.

We utilize cookies and other information that your browser transmits to better understand our website audience, such information from your Internet connection and browser is integral to the use of the Internet and generally cannot be completely concealed and is available to every other website that you visit. Such information includes aspects of your browser’s technical capabilities, information about your device, and your location in the Internet, which may also show your geographic location.

We may collect contact information from Customer interactions with our Product in order to fulfill the terms of our Agreement or enhance the Product or Professional Services related to the Agreement.

For Customers with user accounts in RADAR, we utilize customer relations and application analytics tools to improve customer relations and monitor the performance of our software. Such information may include frequency and nature of the Customer’s use of the Product and information necessary to troubleshoot any issues reported by the Customer.

Our Customers may, at times, enter information about other natural persons in RADAR for the purpose of tracking events. To the extent we hold such customer-entered personal information, we do not control or direct the processing of that personal information and act as a secure repository only. The functionality of our software does not require the identity of individuals in order to provide accurate risk assessments.

Your Right to Access Personal Information

You have a right to access any personal information about yourself that RADAR holds and be able to correct, amend, or delete that information where it is inaccurate, or has been processed in violation of the Principles, except where the burden or expense of providing access would be disproportionate to the risks to your privacy in the particular situation, or where the rights of persons other than yourself would be violated. To access your information, utilize the interface in RADAR for managing your personal information or contact us through methods specified in section 10.

2. Choice

By providing any personal information by entering it into this website or our RADAR services, you are expressly allowing us to collect, hold, and use that data in a manner consistent with this Privacy Notice, our Agreement (if applicable), and the reasonable expectations of a person having read and understood both.

Customers also have the choice and ability update, add, and delete user profile information and User Data in the Product.

You have the choice to opt-out of any use of your data that that exceeds the purposes for which we collect it. We provide notice of those uses in this Privacy Notice and our Agreement (if applicable).

Sensitive Information

We do not solicit or seek to collect “Sensitive Information” under the definition provided by Privacy Shield (i.e., personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual). If you choose to enter Sensitive Information pertaining to an individual, you have clearly agreed to provide that information to us for the purpose of storing that information in our services for your own purposes. We will never use Sensitive Information for any other purpose without your opt-in consent. For your security and in defense of your privacy rights, we only contract with the third parties who also provide the highest level of privacy protection.

At any time, you may also request us to remove you as a user from our system, remove yourself from any mailing list, or purge your personal information from any of our systems, except where the deletion of such information would prevent us from exercising our rights or fulfilling our duties under the contract, such as responding to your inquiries or billing for the Product or Professional Services under our Agreement. We reserve the right to purge your information from the system if retention of that information is reasonable required for the fulfillment of a contractual or legal obligation. If we are required to refuse, we will notify you of the reason.

Your Choices Regarding Cookies and Browser Information

3. Accountability for Onward Transfer

RADAR enters in Business Associate Agreements and contractual clauses for data protection with third parties that provide infrastructure, email, and customer relations tools and process data at our direction. These agreements require that they use your personal information only in a manner consistent with the purposes for which you entrusted it to us and in accordance with the Privacy Shield Principles. We further require that any such third parties provide us with notification in the event of any intentional or unintentional use inconsistent with these principles or where the third party determines that it is no longer able to meet such obligations.

In cases of onward transfer to third parties of data of EU or Swiss individuals received pursuant to the EU-U.S. Privacy Shield or the Swiss-U.S. Privacy Shield respectively, RADAR, Inc. is potentially liable.

3a. Requests by Authorities and Litigants

Pursuant to a lawful request by a public authority for law enforcement or national security purposes, we may be compelled to disclose information held by our Product or Website. In the event of a national security investigation, we may not be permitted to inform you due to certain laws. In the event that we receive any subpoena or request for information pertaining to your personal information that we are permitted by law to disclose, we will contact you in order to provide you with an opportunity to respond.

4. Security

RADAR goes to great lengths to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction in light of the nature of the personal information and the risks involved in processing. Among these these security measures are third-party penetration testing and undergoing third-party audits for standards such as SOC 2 compliance at least annually.

RADAR uses passwords, security questions, and other applicable security measures to prevent an inappropriate entity or individual from gaining access to or knowledge of your data. RADAR cautions its customers and others to be aware that cell phones and e-mail are not secure means of transmitting personal information.

5. Data Integrity

RADAR uses appropriate contractual and quality control measures to ensure that your personal information is accurate and not confused with that of any other individual or User. These measures include updating records at your request, applying quality control procedures to software development, limiting employee access personal information on the basis of their purpose to access such personal information, prohibiting the sharing of user accounts, and other appropriate administrative, quality assurance and technical safeguards.

6. Purpose Limitation

We limit our uses of your personal information to purposes that are related to our commitments to you under our Agreement and/or this Privacy Notice (as applicable). Such purposes may be related to customer service, application performance monitoring, Product improvement, providing information about changes or improvements to our Product or Professional Services, mailing contractual notices, compliance and legal considerations, auditing, security and fraud prevention, preserving or defending the organization’s legal rights, or other purposes consistent with the expectations of a reasonable Customer under the Agreement (or a reasonable user of the Internet, if you are not a Customer).

7. Access

RADAR does not generally collect the personal information of website visitors, and therefore there is no information to which to provide access, however, we will endeavor to respond to requests for access to personal data, except where the burden or expense of providing access would be disproportionate to the risks to your privacy in the particular situation, or where the rights of persons other than yourself would be violated.

If a website visitor enters information into a form to receive marketing material, then the visitor has clear notice that RADAR holds that information for the purpose of continuing contact with RADAR, and the visitor may unsubscribe from future contact through links provided in the communication or by contacting us directly.

Customers have access to personal information about them that RADAR holds and are able to correct, amend, or delete such profile information through the RADAR user interface.

8. Recourse, Enforcement and Liability

RADAR takes your privacy rights seriously, and we provide mechanisms for the resolution of your concerns and any disputes which may arise under the terms of this Privacy Notice.

RADAR® (“RADAR”) uses its best efforts to respect the privacy of online visitors. RADAR does not collect personal information (such as name, address, e-mail address, or phone number) unless you voluntarily provide the information. For example, if you have questions about RADAR’s services, you may provide your e-mail address, and a response to your inquiry will be sent to that e-mail address. You do not need to register or provide information to view some sections of this site.

RADAR is committed to maintaining privacy and security controls over the information that you provide. Appropriate security safeguards and encryptions are utilized to protect your information.
